Any purchase via www.nintendoretrocollection.com implies the Buyer’s unreserved acceptance of the Terms. The Terms may be adapted or modified at any time. In case of modification, the applicable Conditions will be those on line on the date of the order. The Conditions are subject to French law.
2. PRESENTATION DES PRODUITS
The products sold by NintendoRetroCollection are presented on the site with their essential characteristics. NintendoRetroCollection reserves the right to modify its catalogue and the characteristics of the products including the presentation, the marketing date and the packaging. The offers of products and prices displayed on the site are valid within the limit of available stocks.
3. COMMANDE
You can check the details of your order and its total price (and correct any errors) before validating your purchase. NintendoRetroCollection acknowledges receipt of your order by a confirmation email that constitutes proof of the sale concluded (the “Order Confirmation”).
4. TRAITEMENT DE LA COMMANDE
After acknowledging receipt, NintendoRetroCollection processes your order as soon as payment is accepted. Its delivery cannot be cancelled or the address changed.
5. PAIEMENT
Payment is made in cash upon order by Paypal. You can pay online with confidence in the locations provided for this purpose. Your details are encrypted and processed in a fully secured area with a banking institution. NintendoRetroCollection has no access to this confidential information. Upon acceptance of the payment, the information you have provided will be deleted by the banking institution. This is why they are requested from you every time a new transaction is made on the Site.
6. LIVRAISON
The products ordered on the site can be delivered in most countries of the world. When ordering, you choose one of the following delivery providers :
- La Poste
- Mondial Relay
The products are shipped to the delivery address indicated in your order.
7. FRAIS DE LIVRAISON
Delivery is billed based on destination. Please refer to the instructions on the site when choosing the delivery method.
8. DELAIS DE LIVRAISON
NintendoRetroCollection undertakes to deliver the ordered and available products as soon as possible, and no later than 30 days following the order confirmation.
Packages are usually prepared within 24 hours. They are then forwarded to the carriers who deliver the package to your home.
Delivery times vary between carriers and the final destination of the package. The delivery times generally observed are about 48h in Metropolitan France.
For all carriers, it may take a few more days depending on the destination or time of year. No delivery is possible on public holidays. Saturday deliveries are possible but are not guaranteed by La Poste. Orders placed on site are shipped Monday to Saturday – excluding statutory holidays.
In case of an order for several deliverables on different dates, the delivery time for all the ordered products is based on the longest time. In case of delivery delay beyond thirty days from the order confirmation, you can choose to cancel your order. NintendoRetroCollection then undertakes to reimburse you by Paypal.
9. INDISPONIBILITE
NintendoRetroCollection informs you by e-mail of any stock shortage and undertakes to:
- you refund the price of the product unavailable by Paypal transfer.
- or provide you with a product of equivalent quality and price.
10. REFUS DE LA LIVRAISON
ATTENTION: if you receive a damaged package during transport (open package, product missing from the delivery note, broken products, etc.), in order to avoid the cost of return, follow the following procedure:
- refuse the package.
- do not sign the delivery note. Describe the anomaly on the delivery note in the form of "handwritten reservations" with your signature.
11. DROIT DE RETRACTATION
In accordance with Article L.121-20 of the French Consumer Code, you have a period of fourteen clear days, from receipt of the product, to exercise a right of withdrawal without having to justify reasons or pay penalties, with the exception of return costs.
Pursuant to Section 121-20-2 4 of the Consumer Code, items must be returned in their original packaging, unused and accompanied by a copy of the purchase invoice. 13. GARANTIE
NintendoRetroCollection reserves the right to make changes and improvements to its products at any time and without notice. NintendoRetroCollection makes no warranty, condition or representation, express or implied, concerning the notices, their qualities, their commerciabilities or their suitability for a particular purpose. All the characters and brand names appearing in the products are fictitious and any similarity with existing people or organizations would be a pure coincidence. The responsibility of NintendoRetroCollection cannot be incurred for the consequences of a fortuitous case, made by the Prince, of force majeure, fire, flood or natural disaster, disruption or strike, in whole or in part, including postal services and means of transport and/or communications, or any other cause affecting its performance of the order.
In addition to the legal guarantee provided by article R 211-4 of the French Consumer Code, which must be notified to NintendoRetroCollection within a «short time», for products purchased on the site, NintendoRetroCollection guarantees to the buyer that it will not meet, under normal conditions of use, no material or manufacturing failures for a period of 180 days from the date of purchase. NintendoRetroCollection’s sole responsibility under this limited warranty will be, in its sole discretion, to repair or replace any defective media, provided that the original product is returned to NintendoRetroCollection in its original state at the address mentioned above, accompanied by a dated proof of purchase, a description of the failure and an address to which the product must be returned to you. This warranty does not apply to improperly used or damaged or excessively worn media.
To make a return to NintendoRetroCollection, you must make a request to the site.
In order to be able to benefit from the guarantee of the products it is imperative to keep the invoice of purchase of the product.
The warranty is excluded:
• if the product is misused.
• In case of intervention on the product performed without authorization.
• Due to normal wear and tear of the product or negligence or lack of maintenance.
• In case of malfunction resulting from force majeure.
• If the product does not meet the customer’s equipment requirements, including hardware incompatibility.
• In case of customer choice error.
